The Civil Transactions Law regulates disclosure of material information before a contract is concluded. Assessing a complaint requires identifying what was withheld and how it affected the decision to contract or the agreed terms.
Record who knew the information, when it became known, the questions asked and the answers given. Preserve the offer, disclosure documents, inspection reports and correspondence. Explain the particular loss and its connection to the alleged non-disclosure.
Not every omitted detail is legally material. A regulatory restriction preventing the intended use of property may require a different assessment from an administrative detail that would not influence the transaction.
Federal Decree-Law No. 25 of 2025 entered into force on 1 June 2026. Check the dates, applicable special legislation and temporal rules for the particular case.
