Enforcing a judgment in Abu Dhabi
Enforcement starts with an instrument that meets the applicable legal requirements. An invoice or signed document is not automatically an executable instrument. Provide the judgment or instrument, the parties’ details, the amounts awarded and the record of payments and earlier steps.
Separate the award, balance and enforcement dispute
Calculate the amount sought by reference to the instrument and credit any payments already made. Do not add a new claim merely because an enforcement file exists. An objection does not necessarily stop every measure. A dispute over the instrument, an enforcement measure or a third party’s rights requires its own procedural assessment. A settlement should clearly address payment terms and the treatment of the existing file.
Start with the instrument to be enforced
Provide the judgment or other instrument and the related orders or documents available to you. If an enforcement file already exists, include its number, previous applications, decisions and payment record. Opening a file, following an existing file and assessing an objection require different initial reviews.
Prepare a supported outstanding balance
Separate the amount recorded in the instrument from later payments and provide evidence for each payment or settlement. Identify whether the dispute concerns the balance, liable party, scope of the instrument or an action already taken. The amount alone does not explain the enforceability or procedural position of the file.
Define the enforcement service you need
Explain whether you seek an assessment of the instrument, help opening a file, follow-up of existing applications or advice on an issue raised by the other party. This helps define missing records, the scope of follow-up and fees in light of the instrument, jurisdiction and available procedures.
