Reasons a Divorce-for-Harm Case May Be Rejected in the UAE: Why Claims Fail and What Happens Next

Reasons a Divorce-for-Harm Case May Be Rejected in the UAE: Why Claims Fail and What Happens Next

The legal starting point

Article 71 addresses judicial divorce where harm is proven and reconciliation is unsuccessful. Article 72 states that the court dismisses the case where harm is not proven.

Common reasons for failure

A claim may be weakened by failure to prove the alleged incident, evidence unrelated to the central allegation, general or indirect witness testimony, inconsistent accounts, electronic messages without adequate context, or reliance on a medical report or complaint that does not establish the required facts.

Marital problems versus legally proven harm

A difficult marriage or serious disagreement does not automatically mean that the legal requirements for divorce for harm have been established. The court decides on the facts and evidence before it.

After dismissal

If discord continues, Article 72 permits the harmed spouse to file a new case after the judgment becomes final or six months from the first-instance judgment, whichever is later, unless new harm arises requiring dissolution or new circumstances and facts arise for the court to assess.

The six-month rule

The rule should not be reduced to simply waiting six months. Finality of the earlier judgment, the six-month period and the statutory exceptions must all be considered.

Arbitrators

Where the statutory conditions are met and reconciliation is impossible, arbitrators may be appointed. They hear the spouses, investigate the causes of discord and seek reconciliation, within an arbitration period not exceeding 60 days from appointment.

Improving a case file

Material facts should be stated clearly, each fact should be linked to its supporting evidence, dates and accounts should be checked for consistency, and the legal effect of each report, complaint or message should be understood before filing.

Read the judgment first

After a dismissal, the first task is to understand why the court rejected the claim. The reason for dismissal determines whether the issue concerns proof, legal characterization, procedure or another matter and therefore affects the next step.

Five common weaknesses in a harm claim

A claim may be weakened by vague allegations, uncertain attribution, evidence unrelated to the asserted harm, unexplained contradictions or failure to address an earlier judgment. These are practical considerations, not an exhaustive statutory list of automatic grounds for dismissal.

Read the reasons, not only the outcome

A decision based on insufficient proof differs from a procedural inadmissibility decision or a finding that proven events do not meet the legal threshold. The reasoning matters for any appeal or later claim.

Can the same evidence be filed again?

The answer depends on the earlier judgment, its binding effect, the cause of action and the statutory framework for continuing discord. Merely changing the wording of a pleading is not necessarily enough.

Is an appeal always the right step?

Appeal strategy depends on available grounds, procedural requirements and deadlines. An appeal is not a guarantee of a different result.

What if a new incident occurs?

A genuinely new incident or material change of circumstances may require a fresh legal assessment. Its date, proof and connection to the applicable statutory exceptions should be examined.
