Divorce for Harm in the UAE: Conditions, Grounds and Methods of Proof

Divorce for Harm in the UAE: Conditions, Grounds and Methods of Proof

Overview

Federal Decree-Law No. 41 of 2024 regulates judicial divorce for harm and continuing marital discord. Article 71 allows either spouse to seek divorce where harm makes continued marital life in kindness impossible.

A marital disagreement alone does not automatically establish legal harm. The court considers the alleged incidents, the evidence supporting them and whether reconciliation is possible.

Conditions

A claim generally turns on identifiable harmful conduct, its effect on married life, proof of the relied-upon facts and failure of reconciliation. The court assesses each case on its own evidence.

Possible grounds

Depending on the facts, the court may examine physical assault, insults, threats, psychological or emotional abuse, serious mistreatment, abandonment-related conduct and other conduct affecting family life. There is no closed list that automatically guarantees divorce.

Proving harm

Evidence may include witness testimony, judgments, police records, medical reports, electronic communications and other admissible documents or circumstantial evidence. The existence of a report, complaint or message does not by itself guarantee proof of harm.

WhatsApp and electronic messages

Electronic messages may be relevant where their attribution, context, content and connection with the dispute can be established. A screenshot alone should not be assumed to determine the case.

If harm is proven

Where harm is established and reconciliation is unsuccessful, the court may order judicial divorce under Article 71.

If harm is not proven

Article 72 provides that the claim is dismissed. If discord continues, a new case may be brought after the judgment becomes final or six months from the first-instance judgment, whichever is later, subject to new harm or new circumstances and facts assessed by the court.

Arbitrators and continuing discord

Where the statutory route applies, arbitrators hear the spouses, investigate the causes of discord and attempt reconciliation. Their arbitration period may not exceed 60 days from appointment.

Compensation

If reconciliation fails, the statutory framework allows the arbitrators to address separation with or without consideration. The court assesses consideration in light of the causes and each spouse's role; consideration paid by the wife may not exceed the dowry stated in the marriage document.

Common mistakes

Common problems include relying on general accusations, submitting evidence unrelated to the alleged incident, assuming one document automatically proves the entire case, and failing to connect each material fact to its evidence.

How should a divorce-for-harm claim be documented?

A practical case file sets out each material incident chronologically, identifies the evidence supporting it, and explains how it affected the marital relationship. General assertions of unhappiness should not be confused with proven conduct meeting the statutory threshold for judicial divorce.

Does a medical report prove marital harm by itself?

A medical report may establish an injury or medical condition, but it does not necessarily identify the person responsible or establish all the legal elements of a divorce-for-harm claim. Its date, context, attribution and supporting evidence matter.

Can WhatsApp messages and recordings be used?

Electronic messages may be relevant subject to admissibility, authenticity, context and judicial assessment. Secret recordings and images can raise separate privacy and legality concerns; the wish to use a recording as evidence does not automatically make its creation lawful.

Can a husband seek judicial divorce for harm?

Article 71 of Federal Decree-Law No. 41 of 2024 refers to either spouse. The court must still determine the relevant facts, proof, legal threshold and any resulting financial or family-law consequences.

What happens if harm is not proven?

Article 72 governs the consequences of failure to prove harm and the route potentially available where discord continues. Any new claim must be assessed against the statutory conditions, prior judgment and circumstances, including potentially new facts.

What should be checked before filing?

Review procedural requirements, the requested relief, a dated chronology, legally obtained evidence and the link between each incident and the claimed inability to continue married life in kindness. Financial claims, child maintenance and custody require separate legal analysis.

How UAE courts assess marital harm

Article 71 of Federal Decree-Law No. 41 of 2024 allows either spouse to seek judicial divorce where harm makes continued marital life in kindness untenable; the court may grant divorce where harm is established and reconciliation has failed. An allegation, proof of the incident, and its legal significance are distinct issues.

Federal Supreme Court Appeal No. 967 of 2025

In its judgment of 7 January 2026, the Federal Supreme Court considered divorce for harm and continuing discord under the 2024 Personal Status Law. The published judgment describes an error in understanding the facts and assessing evidence, and a resulting reversal and dismissal of the divorce claim. Its outcome must be read in light of its particular facts and reasons; it does not create an automatic result for other cases.

Official judgment: Federal Supreme Court, Appeal 967/2025.

What happens after a claim is dismissed?

Article 72 provides that where harm is not proven, the claim is dismissed. If discord continues, the affected spouse may bring a new case after the judgment becomes final or six months from the first-instance judgment, whichever is later, subject to the statutory exceptions for new harm or new circumstances or facts assessed by the court. Where the statutory conditions are met and reconciliation fails, arbitrators may be appointed, with a period not exceeding 60 days from their appointment.

Practical evidence checklist

Record each alleged incident with its date, supporting evidence, source and connection to the asserted harm. A medical report may establish an injury without necessarily identifying who caused it; electronic messages must be assessed for attribution, context and lawful collection. Obtain case-specific legal advice before filing.

Before filing, check the applicable family guidance or reconciliation procedure and any relevant exceptions. Prepare a chronology linking each alleged incident to admissible evidence. The court considers proven harm and failed reconciliation under Article 71. If harm is not established, the separate conditions in Article 72 must be considered; arbitration is not an automatic consequence of a first dismissal.

Practical case pathway: from facts to judgment

Identify each alleged incident and its date, preserve lawfully obtained evidence, and explain how it affects continued marital life. Check the applicable family-guidance procedure, prepare the claim and supporting documents, and present the evidence to the court. If harm is not established, examine the judgment's reasons before considering an appeal or a fresh claim under Article 72; continuing disagreement alone does not automatically establish the legal test.

Conclusion

The strength of a divorce-for-harm claim depends on provable facts, relevant evidence and correct application of the Personal Status Law, not simply on the intensity of the marital dispute.
