Audio Recordings in UAE Courts: Evidence and Privacy

The legal use of an audio recording depends on how it was made, its authenticity and what it proves in context. A voluntarily sent voice note, a recording made with consent and a covert recording raise different issues. Article 44 of Federal Decree-Law No. 34 of 2021 addresses certain privacy violations by technical means. Consent, legal authorisation, purpose and any later disclosure require separate review.

Preserve originals and context

Keep the original audio and related messages, document the time and method of extraction and avoid editing the original. A written transcript can help locate a passage, while the recording and surrounding conversation support technical and contextual review. Articles 53 to 64 of the UAE Evidence Law set the framework for electronic evidence in civil and commercial transactions. A court can require material needed to verify authenticity. An expert may examine integrity or attribution where the available files allow it.
