Forensic Accounting for UAE Bank Loans: Checking the Balance

A forensic accounting review is useful when the outstanding balance cannot be reconciled with the loan contract, the transaction ledger and actual payments. Obtain the original and revised repayment schedules, the full transaction history, restructuring agreements and any settlement quotation. Distinguish outstanding principal from interest or profit, fees, insurance and unallocated payments.

Reconstruct the disputed calculation

For each adjustment, record its date, amount, transaction reference and contractual source. Compare the closing balance before restructuring with the opening balance of the new schedule. For variable-rate finance, check the benchmark, margin and effective dates. Central Bank consumer protection standards explain disclosure requirements for covered products and institutions. Establish which version and regime apply to the particular transaction.

Frame the expert's task

Under Article 109 of the UAE Evidence Law the court may appoint an expert on technical questions required to decide the dispute. Ask for a traceable calculation, identification of missing records and separate results for assumptions the court must resolve. An internal bank complaint or eligible Sanadak complaint may be relevant in suitable cases. A live court or enforcement matter requires separate review of the procedure and deadlines.
