Failure to Pay Court-Ordered Maintenance in the UAE: When Is It a Crime?

Legal overview

Article 382 of the Crimes and Penalties Law requires an enforceable court ruling, ability to pay, and failure to comply for three months following notice to pay. It covers specified family maintenance and related amounts. Proceedings require a complaint from the interested party.

Practical steps

The provision allows imprisonment up to one year, a fine up to AED 10,000, or either penalty. Payment of accrued amounts or provision of a guarantor accepted by the interested party prevents execution of the penalty. Preserve the judgment, notice and payment records.
